PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS PLATFORM AS THEY ARE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND US.

1. Introduction and Acceptance

1.1 About Us

We are RightGhar Technologies Private Limited. Our email address is hello@rightghar.com. We are not a property sales or lettings agency. We are the providers of this Platform. It is our members (which include property owners, landlords, tenants, and buyers) that display property details for you to view.

1.2 Agreement Overview

These Terms of Use ("Terms") set out all of the rules and obligations that apply to your use of our website, mobile application, and all associated services (collectively, the "Platform"). By using our Platform, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our Platform.

1.3 Age Requirement

You must be at least 18 years of age to use our Platform. By using our Platform and accepting these Terms, you confirm that you are at least 18 years of age. Users under 18 may only access the Platform under the supervision and consent of their parents or legal guardians.

1.4 Legal Binding Agreement

We recommend that you download and store a copy of these Terms for future reference. They are a legally binding agreement between you and us. These Terms may also make reference to other policies that apply when using our Platform, such as our Privacy Policy.

2. Platform Availability and Changes

2.1 Platform Modifications

We may from time to time change the content of this Platform or suspend or discontinue any aspect of this Platform, which may include your access to it. We may suspend, withdraw, discontinue or change all or any part of our Platform without notice. We shall not be liable if we cannot process your details due to circumstances beyond our reasonable control.

2.2 Service Availability

We strive to maintain Platform availability but do not guarantee uninterrupted access. We reserve the right to suspend, modify, or discontinue any part of our services for maintenance, updates, legal compliance, or business reasons, with or without notice.

3. User Obligations and Acceptable Use

3.1 Technical Requirements

You accept that you are solely responsible for ensuring that your computer system meets all relevant technical specifications necessary to use this Platform and that your computer system is compatible with this Platform.

3.2 Prohibited Activities

You must not misuse our system or this Platform. In particular, you must not:

  • Hack into, circumvent security or otherwise disrupt the operation of our system and this Platform
  • Introduce viruses, trojans, worms, logic bombs or other material which is or could be malicious or technologically harmful
  • Use or attempt to use any automated program (including spiders or web crawlers) to access our system or Platform
  • Use any scraping technology on the Platform
  • Upload or use inappropriate or offensive language or content
  • Solicit any commercial services in any communication, form or email you send from or to the Platform
  • Attempt to gain unauthorized access to the Platform or related systems or networks
  • Violate intellectual property rights of any person
  • Send spam, duplicated or unsolicited messages
  • Store or transmit obscene, threatening, libelous, or otherwise unlawful material
  • Interfere with or disrupt the integrity or performance of the Platform
  • Modify or make derivative works based upon the Platform
  • Create internet links to the Platform or frame or mirror any content without permission
  • Reverse engineer or access the Platform to build competitive products
3.3 Content Standards

Whenever you make use of features that allow you to upload content to our Platform, or to make contact with other users via our Platform, you must comply with content standards. All content that you upload to our Platform must:

  • Be accurate (where you state facts)
  • Be genuinely held (where you state opinions)
  • Comply with the applicable law of India
3.4 Prohibited Content

Your content must not:

  • Contain any material which is defamatory of any person
  • Contain any material which is obscene, offensive, hateful, discriminatory, unethical, immoral or inflammatory
  • Contain any material which does or could potentially infringe the intellectual property rights of a third party
  • Violate any applicable laws or regulations
  • Promote illegal activities or harm to others
3.5 Business Use Restrictions

If you are acting in the course of business, unless you have our prior written consent, you may not use this Platform for the purposes of undertaking research on the property market or conducting competitive analysis.

4. Registration and Account Management

4.1 Account Creation

To gain access to certain details and services on our Platform you will need to register (free of charge) as a user. You must be at least 18 years of age to register. At our discretion, we may refuse your application for registration.

4.2 Account Security

Each registration is for a single user only. You must not share your username and password with any other person. You must ensure the password you use is unique and must not be re-used anywhere else. You undertake that all information provided by you for registration purposes is accurate and complete.

4.3 Account Responsibility

You accept sole responsibility for all use of and for keeping secret any password that may have been given to you or chosen by you for use on this Platform. You will notify us immediately of any unauthorized use of them or any other breach of security of this Platform of which you become aware.

4.4 Account Termination Rights

We have the right to disable any account or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

5. Barring from the Platform

5.1 Right to Bar Users

We reserve the right to bar users from this Platform and/or restrict or disable their access or use of any or all elements of our services, on a permanent or temporary basis at our sole discretion.

5.2 Grounds for Barring

We may suspend or terminate accounts for:

  • Violations of these Terms
  • Illegal activities or fraudulent behavior
  • Misuse of the Platform or its features
  • Non-payment of fees (where applicable)
  • Inactive accounts (after 180 days of inactivity)
  • Any other reason we deem necessary for the safe and secure operation of the Platform
5.3 Content Removal

We will determine in our discretion whether there has been a breach of these Terms. Where we believe a breach has occurred we may take such action as we deem appropriate, including:

  • Immediate, temporary or permanent withdrawal of your right to use our Platform
  • Immediate, temporary or permanent removal of any posting or material uploaded by you
  • Further legal action against you
  • Disclosure of such information to law enforcement or authorities as we reasonably feel necessary
5.4 Right to Remove Content

We reserve the right to take down any content that you upload to our Platform at any time without notice and without having to give a reason.

6. Geographic Restrictions - Indian Users Only

6.1 Platform Jurisdiction

Our Platform is directed to people residing in India. We do not represent that content available on or through our Platform is appropriate for use or available in other locations.

6.2 Indian Law Compliance

This Platform is designed for users located in India and operates under Indian jurisdiction. All content, services, and interactions on this Platform are governed by Indian laws and regulations, including but not limited to:

  • Information Technology Act, 2000
  • Digital Personal Data Protection Act, 2023
  • Real Estate (Regulation and Development) Act, 2016
  • Consumer Protection Act, 2019
6.3 International Access

If you access our Platform from outside India, you do so at your own risk and are responsible for compliance with local laws in your jurisdiction. We make no representation that our Platform complies with laws outside of India.

7. Intellectual Property Rights

7.1 Platform Ownership

The copyright and all other intellectual property rights in this Platform (including all database rights, trademarks, service marks, trading names, text, graphics, code, files, links and other materials published on it) belong to us or our licensors. All rights are reserved.

7.2 User Content License

All content that you upload to our Platform will be considered non-confidential and non-proprietary and we have the right to use any such content for any purpose, subject to the terms of our Privacy Policy. We also have the right to disclose your identity to any third party who claims that content posted or uploaded by you to our Platform breaches their legal rights.

7.3 Permitted Use

Subject to your compliance with these Terms:

  • If you are a consumer, you may download material from this Platform for the sole purpose of using this Platform where we provide an option for you to do so
  • However, you must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Platform without our prior written consent

If you are a business, you must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Platform without our prior written consent.

7.5 Trademark Rights

Our registered trademarks include "RIGHTGHAR" and associated logos. You must not use or copy them without our prior written consent.

7.6 Copyright Infringement

We respect intellectual property rights and will remove infringing content when properly notified. We may terminate accounts of repeat infringers and take appropriate legal action.

8. Warranties and Disclaimers

8.1 Platform Warranty Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that:

  • Any material available for downloading from this Platform will be free from infection, viruses and/or similar code
  • Your access to, or the running of, this Platform will be uninterrupted or error free
  • The information provided on this Platform is accurate, complete or up to date
  • The property information on this Platform is correct, accurate or up-to-date
  • The Platform complies with laws other than those of India

The information provided on this Platform is for general interest only and does not constitute specific advice. Although we make reasonable efforts to update information on our Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on our Platform is accurate, complete or up to date.

We are not a real estate agency. The details of the properties available on this Platform are provided to us by our members for your information only. We do not verify the property details provided to us and give no warranties or representations as to their accuracy or completeness. If you rely on these details, you do so at your own risk.

9. Our Responsibility for Loss or Damage Suffered by You

9.1 Exclusions We Cannot Make

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for:

  • Death or personal injury caused by our negligence or the negligence of our employees or agents
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under applicable law
9.2 Consumer Users

If you are a consumer user:

  • Please note that we only provide our Platform for domestic and private use
  • You agree not to use our Platform for any commercial or business purposes
  • We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity
  • If defective content that we have supplied damages a device belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation

If you are a business user, we exclude all implied conditions, warranties, representations or other terms that may apply to our Platform or any content on it.

  • Any loss or damage caused by virus, distributed denial of service attack or other technologically harmful material
9.5 Third-Party Interactions

If you choose to contact other users using the Platform, your details will be sent to them. We do not accept any liability for any subsequent communications that you receive directly from other users.

9.6 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Payment and Financial Terms

10.1 Free Platform

Our Platform is made available free of charge for basic services. We may charge fees for premium features or enhanced services.

10.2 Payment Services

Where payment processing services are provided, you authorize us to process payments on your behalf. You must provide accurate payment information and are responsible for all charges and fees.

10.3 Refunds

11.2 Deep Linking Restrictions

You must not include links to this Platform in any other website, application or computer program without our prior written consent. In particular, you must not include any "deep link" to any page on this Platform.

11.3 Framing Prohibited

Our Platform must not be framed on any other site. You must not load any images or any other assets directly from this Platform onto any other website without our prior written consent.

  • Outstanding obligations remain in force
  • Certain provisions survive termination

14. Governing Law and Jurisdiction

14.1 Indian Law

These Terms, their subject matter and their formation, are governed by Indian law. We both agree to the exclusive jurisdiction of the courts of Pune, India.

14.2 Dispute Resolution

Any disputes arising under these Terms shall be resolved through the courts of competent jurisdiction in India. We may also provide alternative dispute resolution mechanisms at our discretion.

15. General Provisions

15.1 Modifications

We amend these Terms from time to time by updating them on the Platform. Every time you wish to use our Platform, please check these Terms to ensure you understand the terms that apply at that time.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

15.3 Assignment

You may not assign or delegate any rights or obligations under these Terms. We may assign this agreement at any time without notice to you.

15.4 Force Majeure

We shall not be responsible for any breach of these Terms caused by circumstances beyond our control.

15.5 Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and us regarding the use of our Platform.
